1. Acceptance of terms

By creating an account or using AsherCharts (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these terms.

2. The service

AsherCharts provides web-based charting, market-analysis and embeddable-chart tools for crypto, equities and foreign-exchange markets. The Service is provided on an "as available" basis. We may add, change or remove features at any time. AsherCharts is not a broker, exchange, custodian, or investment adviser and does not execute trades or hold funds.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information, be at least the age of majority in your jurisdiction, and promptly notify us of any unauthorized use. You may close your account at any time.

4. Subscriptions, billing & cancellation

Free plan. The free tier is available at no cost and may be subject to usage limits.
Paid plans. Paid subscriptions (e.g. Pro, Premium) are billed in advance on a recurring monthly basis through our payment processor. Prices are shown at checkout and may change with notice.
Renewal & cancellation. Subscriptions renew automatically until cancelled. You may cancel at any time from your account; access continues until the end of the current billing period.
Refunds. Except where required by law, payments are non-refundable. We may, at our discretion, offer prorated credits.
Taxes. Prices exclude applicable taxes, which may be added at checkout.

During early access, paid plans may be waitlisted and billing may not yet be enabled; the free plan is available immediately.

5. Embed license

Subject to these terms and your plan, we grant you a limited, non-exclusive, revocable, non-transferable license to embed AsherCharts charts on websites and applications you control using the embed snippet we provide. Free-tier embeds must retain the "AsherCharts" attribution mark; white-label (attribution-removed) embeds require an eligible paid plan. You may not resell, sublicense, reverse-engineer, or reproduce the underlying chart engine or market data as a standalone product.

6. Acceptable use

You agree not to: (a) use the Service unlawfully or to infringe others' rights; (b) attempt to disrupt, overload, scrape at abusive rates, or gain unauthorized access to the Service or its data; (c) resell or redistribute the market data other than through permitted embeds; (d) misrepresent the Service or remove attribution where required; or (e) use the Service to build a competing charting or data product.

7. Market data & no financial advice

Market data is provided for informational purposes only, "as is" and "as available", and may be delayed, incomplete, or inaccurate. Nothing on AsherCharts constitutes financial, investment, tax or legal advice, a recommendation, or an offer or solicitation to buy or sell any asset. Trading involves substantial risk of loss. You are solely responsible for your own decisions and should consult a licensed professional. Always verify data with an authoritative source before acting on it.

8. Intellectual property

The Service, including the AsherCharts name, logo, chart engine, software, and design, is owned by AsherCharts and its licensors and is protected by intellectual-property laws. Except for the limited embed license above, no rights are granted to you. You retain ownership of any content you create (such as your saved drawings and layouts).

9. Disclaimers & limitation of liability

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASHERCHARTS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM.

10. Termination

We may suspend or terminate your access if you breach these terms or use the Service in a way that risks harm to us or others. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will survive.

11. Changes to these terms

We may update these terms from time to time. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by additional notice. Continued use after changes take effect constitutes acceptance.
